dc.description.abstract | ABSTRACT Melly Aldha Pane Children in Conflict with the Law or known as (ABH) according to Law Number 12 of 2011 concerning the Juvenile Criminal Justice System is the process of resolving cases of children who are in conflict with the law, starting from the investigation to the guidance stage after serving the sentence. Children are the nation's successors so fulfilling their rights is the most important thing. In order to protect children's rights, legal regulations are needed that are in harmony with the development of Indonesian society which is fully imbued, especially for institutions and agencies that have policies in handling children's cases. This research is descriptive legal research, using understanding, knowledge, definition of a particular situation (in a particular context). The main data used is secondary data and primary data as supporting data. Data were analyzed using qualitative methods, by going through an interview process with sources who understand handling children in conflict with the law at the prosecution stage. Settlement of cases of children in conflict with the law at the prosecution stage at the Prosecutor's Office is based on Law No. 11 of 2012 concerning the juvenile criminal justice system, where this settlement prioritizes peace which provides space for both child perpetrators, child victims and child witnesses to be able to carry out their activities freely. their duties as a generation that will still continue to develop. Diversion is always carried out in handling children's cases from the investigation, prosecution, to trial stages in order to find a solution without retaliation. In the process of handling children's cases, from the beginning of receiving the files from the investigation until they reach the hands of the Public Prosecutor, everything must comply with applicable regulations. The process carried out in the prosecution stage has gone very well so far, only because of the obstacles that already lie in the legal system. And the efforts made are in accordance with the obstacles listed. The conclusion is that the handling of cases of children in conflict with the law has almost reached perfection, but there are several obstacles due to legal regulations, and improvements in the mindset of each community and institution.
