Abstract: | ABSTRACT Name : SHEREN DWITA CAHYANI, NPM : 71190212010 Title : PELANGKAHAN BROTHERS IN MARRIAGE PERSPECTIVE OF JAVANESE AND TRADITIONAL LAW (A CASE STUDY OF SUKA DAMAI VILLAGE, KUALA DISTRICT, LANGKAT. Suka Damai Village, Kuala District, Langkat Regency in general are Javanese and the majority of the population is Muslim. The Javanese in Suka Damai Village, Kuala District, there are still frequent marriages where a younger sibling steps over his/her older sibling, in this case a younger sibling who wants to get married is required to step over his/her siblings both in kind and in the form of money. The existence of someone who oversteps his biological brother in marriage also occurs in many other tribes in Indonesia. Therefore, the author wants to examine more closely the customs of sibling steps in Javanese marriages from the perspective of Islamic law. This study aims to describe the practice of carrying out the Javanese customary tradition in Suka Damai Village, Kuala District. To describe the impact of the practice of carrying out the tradition of stepping on siblings in Javanese Traditional marriages in Suka Damai Village, Kuala District.To analyze the view of Islamic law on the Tradition of Stepping on Siblings in Javanese Traditional Marriage in Suka Damai Village, Kuala District. This research method is qualitative with interview data collection techniques and descriptive analysis. The results of this study are that the practice of carrying out the Javanese tradition in Suka Damai Village, Kuala District is to carry out the habit of a younger sibling giving steps to his older brother because a younger sibling first gets a mate, where this tradition in the Javanese Tribe of Suka Damai Village usually makes a stepping event that seats between younger siblings and older siblings and giving a token of appreciation to an older sibling as a request for permission to obtain a blessing. The impact of the practice of carrying out the tradition of stepping on siblings in Javanese Traditional marriages in Suka Damai Village, Kuala District has positive and negative impacts. his marriage in the future. Views of Islamic Law on the Tradition of Stepping for Siblings in Traditional Javanese Marriage in Suka Damai Village, Kuala District, from the point of view of community members, basically there is no problem, as well as from the perspective of Islamic law that stepping is a general habit to become a custom, because it does not violate the pillars and conditions marriage is justified.
