dc.description.abstract | KEBIJAKAN PENEGAK HUKUM DALAM PENERAPAN RESTORATIF JUSTICE TERHADAP ANAK SEBAGAI PELAKU TINDAK PIDANA ABSTRAK Muhammad Ilman Dani Lubis * Penerapan prinsip restoratif justice dalam menangani tindak pidana yang dilakukan oleh anak secara yuridis formil telah diatur di dalam UndangUndang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Rumusan masalah dalam tesis ini adalah bagaimana pengaturan hukum restoratif justice terhadap anak sebagai pelaku tindak pidana, bagaimana penerapan restoratif justice dalam menyelesaikan tindak pidana perlindungan anak, bagaimana hambatan dalam menerapkan restoratif justice terhadap tindak pidana perlindungan anak. Metode penelitian yang digunakan adalah deskriftif analisis yang mengarah pada penelitian hukum yuridis normatif dan yuridis empiris yakni penelitian yang dilakukan dengan cara mengacu pada norma-norma hukum yaitu meneliti terhadap bahan pustaka atau bahan sekunder dan penelitian lapangan. Data primer dansekunder dengan mengolah data dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Pengaturan hukum restoratif justice terhadap anak sebagai pelaku tindak pidana diatur dalam Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Hakim tidak memberikan restorative justice dengan melaksanakan diversi terhadap anak yang melakukan tindak pidana kekerasan terlihat dalam putusan hakim dimana hakim hanya mengacu pada pasal-pasal pelaksanaan diversi dalam UU Nomor 11 Tahun 2012, PERMA Nomor 4 Tahun 2014 dan KUHP. Penerapan restoratif justice dalam menyelesaikan tindak pidana perlindungan anak adalah memfokuskan kepada kebutuhan dari pada para korban, pelaku kejahatan, dan juga melibatkan peran serta masyarakat, dan tidak semata-mata memenuhi ketentuan hukum atau semata-mata penjatuhan pidana. Korban juga dilibatkan di dalam proses, sementara pelaku kejahatan juga didorong untuk mempertanggungjawabkan atas tindakannya, dengan memperbaiki kesalahan-kesalahan. Hasil penelitian menunjukkan bahwa hambatan dalam penerapan restoratif justice terhadap anak sebagai pelaku tindak pidana kekerasan adalah masih sangat terbatasnya baik sarana fisik bangunan tempat pelaksanaan restorative justice, maupun non fisik yaitu belum tersedianya tenaga-tenaga professional seperti dokter, psikolog, tenaga instruktur ketrampilan dan tenaga pendidik di berbagai tempat dimana anak di tempatkan selama dalam penanganan proses hukum. Kata Kunci: Kebijakan, Restoratif justice, Anak. *Mahasiswa Program Pascasarjana Program Ilmu Hukum Universitas Islam Sumatera Utara.LAW ENFORCEMENT POLICY IN THE APPLICATION OF RESTORATIVE JUSTICE AGAINST CHILDREN AS CRIMINAL ACTORS ABSTRACT Muhammad Ilman Dani Lubis* The application of the principle of restorative justice in dealing with criminal acts committed by children in a formal juridical manner has been regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The formulation of the problem in this thesis is how to regulate restorative justice for children as perpetrators of criminal acts, how to apply restorative justice in resolving child protection crimes, how are the obstacles in implementing restorative justice for child protection crimes. The research method used is descriptive analysis that leads to normative juridical and empirical juridical research, namely research carried out by referring to legal norms, namely researching library materials or secondary materials and field research. Primary and secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. Restorative justice legal arrangements for children as perpetrators of criminal acts are regulated in Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. Judges do not provide restorative justice by carrying out diversion against children who commit violent crimes as seen in the judge's decision where the judge only refers to the articles on the implementation of diversion in Law Number 11 of 2012, PERMA Number 4 of 2014 and the Criminal Code. The application of restorative justice in solving child protection crimes is to focus on the needs of the victims, perpetrators of crimes, and also involve the participation of the community, and not merely to fulfill legal provisions or merely to impose criminal charges. Victims are also involved in the process, while criminals are also encouraged to take responsibility for their actions, by correcting mistakes The results of the study indicate that the obstacle in implementing restorative justice against children as perpetrators of violent crimes is that they are still very limited, both physical facilities where the implementation of restorative justice is carried out, and non-physical facilities, namely the unavailability of professional personnel such as doctors, psychologists, skill instructors and educators. in various places where children are placed during the handling of the legal process.
