dc.description.abstractABSTRAK ANALISIS PUTUSAN HAKIM DALAM PROSES PERADILAN PIDANA RINGAN DALAM PERSPEKTIF PERATURAN MAHKAMAH AGUNG NOMOR 2 TAHUN 2012 (Studi Putusan Pengadilan Negeri Lubuk Pakam Nomor 36/Pid.C/2020/ PN.Lbp) Arham * Tindak pidana ringan akhir-akhir ini menarik perhatian publik karena penanganannya dianggap tidak lagi proporsional dengan tingkat keseriusan tindak pidana yang diatur. Tujuan penelitian dalam tesis ini adalah untuk mengetahui pengaturan penyelesaian tindak pidana ringan dalam proses peradilan pidana, untuk mengetahui penyelesaian tindak pidana ringan dalam proses peradilan pidana perspektif Peraturan Mahkamah Agung RI Nomor 2 Tahun 2012, untuk mengetahui pertimbangan hukum hakim dalam putusan Pengadilan Negeri Lubuk Pakam Nomor 36/Pid.C/2020/PN.Lbp. Penelitian yang dilakukan adalah penelitian hukum yuridis normatif dengan pendekatan yuridis empiris dengan menggunakan data primer dan didukung dengan data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Pengaturan penyelesaian tindak pidana ringan dalam proses peradilan pidana diatur dalam Peraturan Mahkamah Agung RI Nomor 2 Tahun 2012 tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda dalam KUHP dan sebagai tindak lanjut dari PERMA telah dibentuk Nota Kesepakatan Bersama Nomor 131/KMA/SKB/X/2012,;Nomor M.HH.-07.HM.03.02 Tahun 2012; Nomor :KEP-06/E/EJP/10/2012; Nomor:B/39/X/2012, Rabu, tanggal 17 Oktober 2012 tentang Pelaksanaan Penerapan Penyusunan Batasan Tindak Pidana Ringan dan Jumlah Denda, Acara Pemeriksaan Cepat, serta Penerapan Keadilan Restoratif (Restoratif Justice). Penyelesaian tindak pidana ringan dalam proses peradilan pidana perspektif Peraturan Mahkamah Agung RI Nomor 2 Tahun 2012 belum menjamin ditegakannya untuk memenuhi rasa keadilan dalam hukum. Berdasarkan hasil penelitian dipahami bahwa pertimbangan hukum hakim dalam putusan Pengadilan Negeri Lubuk Pakam Nomor 36/Pid.C/2020/PN.Lbp adalah seluruh unsur tindak pidana yang didakwakan kepadanya telah terpenuhi dalam diri dan perbuatan Terdakwa maka haruslah dinyatakan bahwa Terdakwa telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana pencurian ringan serta tidak ditemukannya alasan pemaaf maupun pembenar dalam diri terdakwa. ABSTRACT ANALYSIS OF JUDGE'S DECISION IN JUDICIAL PROCESS MIDDLE CRIMES IN REGULATION PERSPECTIVE SUPREME COURT NUMBER 2 YEAR 2012 (Study of Lubuk Pakam District Court Decision Number 36/Pid.C/2020/PN.Lbp) Arham* Minor crimes have recently attracted public attention because their handling is considered no longer proportional to the seriousness of the regulated criminal acts. The formulation of the problem in this thesis is to know to regulate the settlement of minor crimes in the criminal justice process, to know resolve minor crimes in the criminal justice process from the perspective of the Indonesian Supreme Court Regulation Number 2 of 2012, to know the judges' legal considerations in the Lubuk Pakam District Court decision Number 36/Pid .C/2020/PN.Lbp. The research carried out is normative juridical law research with an empirical juridical approach using primary data and supported by secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The regulation of the settlement of minor crimes in the criminal justice process is regulated in the Regulation of the Supreme Court of the Republic of Indonesia Number 2 of 2012 concerning Adjustment of the Limits of Minor Crimes and the Amount of Fines in the Criminal Code and as a follow-up to PERMA a Memorandum of Understanding has been formed Number 131/KMA /SKB/X/2012,;Number M.HH.-07.HM.03.02 Year 2012; Number :KEP-06/E/EJP/10/2012; Number: B/39/X/2012, Wednesday, October 17, 2012 concerning Implementation of the Implementation of the Compilation of Minor Crime Limits and the Amount of Fines, Quick Examination Procedures, and the Implementation of Restorative Justice. The settlement of minor crimes in the criminal justice process in the perspective of the Regulation of the Supreme Court of the Republic of Indonesia Number 2 of 2012 does not guarantee that it will be enforced to fulfill a sense of justice in law. Based on the results of the study, it is understood that judge's legal considerations in the Lubuk Pakam District Court's decision Number 36/Pid.C/2020/PN.Lbp are all elements of the criminal offense charged with him having been fulfilled in himself and the Defendant's actions, it must be stated that the Defendant has been legally and convincingly proven guilty of committing the crime. minor theft and no excuse or justification was found in the defendant.
